Are Employee Gifts Taxable? What De Minimis Actually Means

Are employee gifts taxable: leather luggage tags as tangible property rather than a gift card

The IRS describes a de minimis fringe benefit as property or service of so little value, taking into account how frequently similar benefits are provided, that accounting for it would be unreasonable or administratively impracticable. The same guidance is explicit that cash and cash equivalents are treated differently: gift certificates, gift cards and the use of a charge or credit card are "never excludable as a de minimis benefit," no matter how little the amount. The detail sits in IRS Publication 15-B, Employer's Tax Guide to Fringe Benefits. The dollar figures on this page are the widely published federal baselines as of 2026 – limits change, so confirm the current numbers with your accountant before you plan a gifting budget around them.

This page describes what the IRS publishes. It is not tax advice, it contains no planning suggestions, and how any of it applies to your payroll belongs with your accountant or payroll provider.

What the publication actually says

Point What Publication 15-B states
Definition A de minimis benefit is property or service of so little value that accounting for it would be unreasonable or administratively impracticable, taking frequency into account.
Cash equivalents Gift certificates, gift cards and charge or credit card use are never excludable as de minimis, no matter how little the amount.
Dollar limit No specific dollar threshold is stated for de minimis benefits.
Examples given Holiday or birthday gifts of low fair market value other than cash, occasional parties or picnics, occasional entertainment tickets, occasional personal use of a copying machine.
Achievement awards Awards for length of service or safety achievement have their own rules, with $1,600 for qualified plan awards and $400 for awards that are not qualified plan awards.
What awards exclude Cash, cash equivalents, gift cards, gift coupons and gift certificates are outside the achievement-award treatment, along with vacations, meals, lodging and tickets.

Two features of that table catch most people out. There is no published dollar line for de minimis, so the "under $25 is fine" rule of thumb that circulates in HR forums is not something the IRS states. And frequency is part of the definition, so the same item can sit differently depending on how often it is given.

Why gift cards are the sharp edge

The gift card question is the most searched version of this topic and it has the clearest published answer. A cash equivalent is a cash equivalent, and the guidance says so without a threshold attached. That is a materially different position from the one that applies to low-value merchandise, which is why so many employers who start with gift cards end up asking their payroll provider what to do next.

This is also the honest commercial bridge, stated once: the distinction between cash equivalents and tangible property is a large part of why employers hand out objects rather than cards. Whether a particular object qualifies for any particular treatment is not a question a leather workshop can answer, and it is a good one to put to an accountant before a program rolls out.

Length-of-service awards sit in their own box

Employee achievement awards are a separate regime rather than a subset of de minimis. Publication 15-B sets out that the awards must be for length of service or safety achievement, must be presented meaningfully, and must not create a significant likelihood of disguised pay. It gives the figures of $1,600 for qualified plan awards and $400 for awards that are not qualified plan awards, and it puts cash and gift cards outside the treatment entirely.

If your recognition program is built around tenure milestones, that is the section of the publication to read alongside your accountant. The purchasing side of the same question sits in service awards without the plaque.

The employer's own deduction is a different question

Whether a gift is taxable to the employee and whether the employer can deduct it are separate questions with separate rules. The $25 per-recipient limit that people quote most often comes from the business-gift rules in Publication 463 and applies to gifts to clients and business contacts rather than to employee compensation. Confusing the two is the most common error in this whole area. The client-gift side is described in how the $25 client gift deduction works.

What this catalog costs, for the budgeting side of the conversation

Logo-stamped leather luggage tags run $14.00 per tag at 6 to 14 pieces, $13.00 at 15 to 29, $11.00 at 30 to 98 and $8.50 at 99 and up, with tag-and-keychain sets at $17.50 down to $10.00. A single personalized keychain is $21.90 at retail. Journals at $51.00 and everything else are quoted against quantity through the custom logo request form. Those are prices rather than tax positions.

Common questions

Are employee appreciation gifts taxable income?

It depends on what the gift is and how it is characterized. The IRS excludes de minimis fringe benefits from income where the value is small enough that accounting for it would be unreasonable or impracticable, and it treats cash equivalents differently. Your accountant should confirm your specific case.

Are gift cards to employees taxable when merchandise may not be?

Publication 15-B states that gift certificates, gift cards and charge or credit card use are never excludable as a de minimis benefit, no matter how little the amount. Low-value merchandise is addressed under the de minimis definition instead.

Is there a dollar limit on non-taxable employee gifts?

The publication does not state a specific dollar threshold for de minimis benefits. It defines them by value and frequency together rather than by a number, which is why widely repeated figures should be checked against the source.

Are years of service awards taxable to employees?

Length-of-service awards fall under the separate employee achievement award rules, which carry their own conditions and the figures of $1,600 for qualified plan awards and $400 for awards that are not qualified plan awards. Cash and gift cards are outside that treatment.

How should employee gifts be categorized in bookkeeping?

That is a question for your accountant or bookkeeper, and the answer depends on the nature of the gift and your entity. What is useful to bring to that conversation is the invoice, the recipient list and the occasion.
